Uniform
Conservation Easement Act
The Uniform Conservation Act (the Act) is a model act upon
which many states, including North Carolina, have based their
own enabling laws for the establishment of state conservation
easement programs. The Act was created and recommended for
use by all states by the National
Conference of Commissioners on Uniform State Laws,
a non-governmental body that drafts many forms of uniform
laws for use by state and local governments. The Act enables
the attachment of obligations and restrictions to real property
to protect historic sites and natural resources. North Carolina's
Conservation and Historic Preservation Agreement Act, N.C.
GEN. STAT. §§121-34 to 42 is based upon this Act and is
included in the North Carolina
Statutes and Acts section of this website. Included in
this section is the Act and a discussion by the Commissioners
of the uses and limitations of the Act.
