Models Disclaimer
The intent of the editors of these models was to produce "clean" examples that give local governments a great deal
of operational and fiscal flexibility. However, these models are provided
here only for review, reference, and example purposes. They do not constitute
legal documents or the provision of legal advice. For these models to
be valid and legally enforceable they must be modified, reviewed, and approved by
a county board of commissioners or a town council and their respective local government attorney or other legal counsel.
Many of the provisions in these documents are required while others are optional.
All guidance and authority for what local governments must and may include in their models
is derived from The Farmland Preservation Enabling Act, N.C.G.S. 106-735, et.
seq. and Chapter 153A for counties and Chapter 160A for cities. Additional authorities may also apply. Please refer to the notes for each of these models where available for additional guidance and explanations as to how they may be used. Counties or municipalities seeking assistance on developing and drafting ordinances or agreements may contact the School of Government at 919-966-5381 or
visit their website at http://ncinfo.iog.unc.edu
(read as http://ncinfo.iog.unc.edu). Counties
may also obtain assistance from the North Carolina Association of County Commissioners
by calling 919-715-2893 or visiting their website at http://www.ncacc.org
(read as http://www.ncacc.org). Municipalities may obtain assistance from the North Carolina League of Municipalities by calling 919-715-4000 or visiting their website at http://www.nclm.org/ (read as http://www.nclm.org/).
